Starting an accommodation business?
Under the Public Health and Wellbeing Act 2008 (Vic) prescribed accommodation premises are required to be registered with their local council.
The types of prescribed accommodation that are required to be registered are defined in the Public Health and Wellbeing (Prescribed Accommodation) Regulations 2020 (Vic):
Hotel
|
A residential hotel and any residential premises in respect of which a general licence or on-premises licence is granted under the Liquor Control Reform Act 1998 (Vic). The primary purpose of the hotel is an accommodation facility but can operate as a pub. |
Motel
|
A type of hotel in the form of a single building of connected rooms with doors that face a parking lot. Similar to a hotel, intended to provide short-term accommodation for travelers. |
Hostel
|
Any house, building or structure whether temporary or permanent which is used primarily for the accommodation of travelers. |
Student dormitories
|
Any dormitory, student, hostel, hall of residence or residential college for the accommodation of students which is controlled by or operated under an arrangement with or affiliated with an educational provider for children or adults. |
Holiday camp
|
Any house, building or structure, whether temporary or permanent, which is used for the accommodation of student groups, youth groups or family groups for holiday or recreational purposes |
Rooming house
|
A building, other than an SDA dwelling, in which there is one or more rooms available for occupancy on payment of rent in which the total number of people who may occupy those rooms is not less than 4.
A building is not a rooming house under the Public Health and Wellbeing Act 2008 (Vic) if:
- the building has less than 4 occupants or
- the building has 4 or more occupants who all reside in self-contained apartments.

Residential accommodation
|
All or part of any house, building or other structure used as a place of abode where people can live on payment of consideration to the proprietor but does not include other types of prescribed accommodation. |
Labour hire accommodation |
Any house, building structure or site (including any shared facilities on a site), whether temporary or permanent, used to provide accommodation for a worker under, or in connection with, a labour hire arrangement with that worker:
- whether or not that work pays for the accommodation; and
- in which the total number of workers who may occupy the accommodation is not less than 4; and
- if the accommodation is not of a class of accommodation to be prescribed accommodation

The following accommodation is exempt from the requirement to be registered with us:
- A house under the exclusive occupation of the occupier;
- Self-contained flats under the exclusive occupation of the occupier;
- Temporary crisis accommodation;
- Health and residential services;
- Nursing homes;
- Retirement villages;
- Any vessel tent or caravan; and
- Premises in which, no more than five people who are not family members of the proprietor are accommodated, which is premises that is not a rooming house.
