Wodonga City Council (Council) gives notice under Section 114 of the Local Government Act 2020 (Act) that it intends to sell the land described below (Proposal).

The land which is the subject of the Proposal is the land contained in certificate of title volume 11000 folio 521, and located at Lot 102 Bilston Drive, Barnawartha North, Victoria 3691 (Land).

The Proposal is that the Land be sold by private treaty to Blue Sky Forever Pty Ltd (ACN 658 239 377) and/or nominee, on the following key terms:

a.    a purchase price of $2,600,000 plus GST;
b.    payment of a deposit equal to 10% of the price;
c.    settlement will be due on the date which is 36 months after the day of sale (or earlier by agreement between the parties);
d.    the sale will be conditional on the purchaser procuring a planning permit to develop and use the Land as a transport and logistics hub, including (but not limited to) warehousing, office space, tyre servicing and fuel storage (Permit), by no later than the date which is 12 months after the day of sale; and
e.    as a condition of sale, the purchaser must enter into an agreement with Council pursuant to section 173 of the Planning and Environment Act 1987, which requires the purchaser to:

i.    develop the Land in accordance with the Permit;
ii.    practically complete construction of Stage 1 of the development within 2 years after the date of settlement of the contract; and
iii.    practically complete construction of Stage 2 of the development within 5 years after the date of settlement of the contract.

A person may make a written submission on the Proposal. Any person proposing to make a submission must do so by 5pm on Monday, July 25, 2022 .
