In certain instances legislation may require the council to disclose personal and/or health information. This form may be used by persons seeking such information.
The Building Act 1993 (Part 7, Section 84) determines that an owner who is required by the building regulations to carry out protection work in respect of an adjoining property before or during the carrying out of building work for which a building permit is required, before commencing the building work, serve on the owner of the adjoining property and the relevant building surveyor notice of the proposed building work.
This may require the use of personal property information to serve the notice.
The Fences Act 1968 provides that any person desiring to compel any other person to construct or contribute to the construction of a dividing fence may serve a notice to fence on the other person.
Property owners may seek a dispensation(s) via a report and consent for proposed building work that is a variance from the requirements of the Building Regulations 2006 (e.g. a building is closer to a front boundary than allowed under the Regulations).
When this occurs comments must be sought from the adjacent property owner(s) in relation to the siting dispensation(s).
This may require the use of personal property information to seek the comment.
